Drunk Driving Accidents
An injury caused by a drunk driver is one of the most upsetting types of personal injury cases. Unfortunately, many insurance companies try to treat these types of cases the same as any other car accident. The truth is, they are not the same. At Moss Berg Injury Lawyers, we take drunk driving accidents very seriously.
The penalties for DUI (driving under the influence) in Nevada are strict:
First Offense: 2 days to 6 months in jail; $400 – $1,000 fine and penalties; license suspended for 90 days; Ignition Interlock Device (IID) possibly required.
Second Offense: 10 days to 6 months in jail; $750 – 1,000 fine and penalties; license suspended for 1 year;
Ignition Interlock Device (IID) possibly required.
Third Offense: 1 to 6 years in jail; $2,000 – $5,000 fine and penalties; license suspended for 3 years;
Ignition Interlock Device (IID) definitely required.
The lookback period (also known as the “washout period”) is 7 years in Nevada. This is the period of time that prior DUIs are relevant for sentencing.
The maximum blood alcohol content (BAC) level considered “drunk” in Nevada is .02% for driver under 21 years old and .08% for drivers 21 or older. Nevada has an implied consent law. That means that if a driver refuses to submit to a chemical test, he/she will be subject to a fine and automatic license suspension.
